I would like everyone to know that Marc Zimet did an amazing job for our insured yesterday.  (The insured) failed to pass on a Notice of Claim to its client’s insurer (itself an insurance broker) and was subsequently denied coverage by its prior insurer as a result.  The underlying claim against our insured’s client ballooned to over $2 million.  The client placed its successor carrier on notice of the matter, which defended for 2 years until it noticed that the insured’s client had disclosed the matter in its application. The insurer then filed a declaratory action against the insured’s client causing the insured’s client to demand that our insured defend and indemnify it. 

Marc was brought in to try to limit the exposure to our insured and handle the likely litigation by its client or its client’s insurer, through subrogation.  With only a couple of weeks to prepare, Marc attended the global mediation.  Marc provided the defense arguments for the mediator to use with the plaintiff, and also helped convince our insured’s client’s insurer to pay a significant but reasonable amount to settle the underlying case.  Marc achieved resolution and protection for our insured in return for our insured paying only a nominal amount as part of the global resolution.

Truly a great result.
